CNC control warranty is 2 years from the date of delivery, inclusive of parts and labor. This warranty shall not apply to any Goods which have been subjected to accident, neglect or abuse. In addition, emachinetool.com shall not be liable for any defect caused as a result of (i) Buyer's failure to insure that the Goods are maintained and operated under proper conditions by trained personnel; (ii) failure of electric power, air conditioning or humidity control; (iii) programming malfunctions, or (iv) damage suffered while the Goods are in transit. emachinetool.com shall not be liable for repair or subsequent work performed by any person other than emachinetool.com or its designee. EXCEPT AS EXPRESSLY STATED ABOVE, EMACHINETOOL.COM MAKES NO WARRANTY, EXPRESS OR IMPLIED, AND EMACHINETOOL.COM SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL EMACHINETOOL.COM BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, CONSEQUNTIAL OR SPECIAL DAMAGES, (INCLUDING BUT NOT LIMITED TO LOST PROFITS), LOST GOODWILL, IMPAIRMENT OF OTHER GOODS, LOSS BY REASON OF SHUTDOWN OR NON-OPERATION, INCREASED EXPENSES OF OPERATION, OR CLAIMS OF BUYER OR CUSTOMERS OF BUYER FOR SERVICE INTERRUPTION WHETHER OR NOT SUCH LOSS OR DAMAGE IS BASED ON CONTRACT, WARRANTY, NEGLIGENCE, INDEMNITY, STRICT LIABILITY OR OTHERWISE. New Machine Tool Inspection and Claims: Buyer shall inspect the Goods immediately on their arrival and shall, within five (5) days thereof, give written notice to emachinetool.com of any claim that the Goods did not conform with the terms of the agreement. If such notice is not given within five (5) days, the Goods shall be deemed to conform with the terms of the agreement and Buyer shall be bound to accept and pay therefor in accordance with the terms of the agreement. Buyer shall not return any Goods without emachinetool.com's prior written consent.
